Unfortunately for them, it's very hard to do something unusual – such as commit a fraud – without behaving in ways that are different from patterns that have been established over time and across peer groups. Those differences can be very minor and very subtle, invisible even to the perpetrator. That is the essence of what makes it hard for the would-be fraudsters to completely cover their tracks. In an antitrust matter, a company was being investigated concerning price fixing allegations. Cataphora analytics identified strong evidence that non-electronic channels were being used in unusual ways; the intent appeared to be to avoid creating a written record of dubious practices. The pattern of when conversations were "taken offline" changed significantly during the period in question. Also, detection of opportunities for in person meetings found that these patterns corresponded strongly with simultaneous price changes. In a white collar criminal investigation, a company executive claimed that she was excluded from the decision making on the most important topics, including such areas as M&A transactions and strategic planning. Careful analysis of communication patterns within the organization revealed that this person was indeed routinely central to discussions of certain types of matters such as HR issues, but was peripheral to the important topics of interest. In a shareholder lawsuit, a company denied the allegation that projections were made to fit the desired result, instead of accurately reflecting financial health. Cataphora reconstructed the normal workflow by which projections were produced, and showed how they were greatly altered during the period in question to avoid factual checks. In an options backdating case, lawyers were unable to find evidence of how options were granted. Organizational analysis discovered key participants in the process previously unknown to the case team. Additional data collected from these participants proved the case. In a product liability case, our client questioned whether data produced to them was complete. Discussion™ building revealed a large number of "unresolved nodes," e.g. items that should have been there, but were not. In addition, tracking topics and shared textblocks showed that particular custodians selectively delete items vital to the case. This evidence revealed which custodians had chosen to violate a preservation order. Project process
