What's the Problem?

Only 10-20% of an electronically stored information (ESI) collection is produced for a typical litigation. The rest is either rendered on a privilege log (5% max) or it is entirely irrelevant for the proceedings at hand. That means 75-85% of the manually reviewed ESI is completely irrelevant. That's a lot. That means 75-85% of the time, effort, and cost of document review is devoted to ESI that will have no bearing on the case at all. Not ever. That means that when practicing crisis management becomes imminent, and large review teams are working 20-hour days at end game, it is because the same effort was exerted reviewing the irrelevant 75-85% of the dataset as it was the relevant 15-25% - or even the essential 5% of the dataset.

What remains are a vastly reduced timeframe and budget that could otherwise be applied to substantive analysis of the ESI that may ultimately be entered as evidence.

Why C-Relevance?

While most automated-review systems operate within a black box of algorithmic obscurity, C-Relevance transparently mirrors the intent of document review and analysis with measured accuracy, which helps our clients affirm that they have complied with their discovery obligations. The process is verified by independent statistical analysis, and the results can be attested by any expert witness competent in statistical sampling and analysis.

In many situations, scheduling constraints or financial concerns could very well prohibit the undertaking of complete manual review. In many other cases, manual review effort that could be better focused on analyzing essential ESI is expended on large volumes of ESI that present a low risk of exposure.

75-85% percent of the review effort may be wasted on reviewing entirely irrelevant ESI. Automated review can significantly reduce - or entirely eliminate - the need for the time-consuming, expensive process of conducting manual review on huge quantities of low-risk or irrelevant ESI.

Can you still manually review what is reviewed using C-Relevance?

Yes, absolutely. Performing automated review through the C-Relevance system can be used as a means to segment and categorize privileged or otherwise sensitive ESI for manual review in C-Evidence, which can and will greatly increase the efficiency of that manual review while minimizing risk. Automated review using C-Relevance is not an "all or nothing" proposition. In most cases, even if you choose to manually review the entire set of ESI marked as relevant to the matter through automated review, you can eliminate 75-80% of your time and effort.

How C-Relevance Works

Cataphora experts work closely with your legal team to fine-tune the C-Relevance system for your desired approach to the specific matter. The system is tested and refined until its results - as measured by objective statistical sampling - conform to an agreed level of quality. At this point, C-Relevance is run for all of the data that has been selected for automatic review.

You can automate the entire review, or combine an automated approach with manual review (for example, you can manually review key custodians' data or material that pertains to some specified critical topic). Along with the automated review, you have the option of running Cataphora's patented and patent-pending analytics to come up to speed on the data without the need for extensive manual review. Careful statistical sampling, optionally coupled with analytics, provides defensibility and the assurance that the process meets or exceeds your established standards for quality and risk management.

  1. Cataphora works with your legal team to learn about the matter and your case strategy.
  2. Cataphora sets up its unique C-Relevance Automated Review system to identify material of interest - for example, responsive, non-responsive, and privileged documents.
  3. C-Relevance conducts a test run over a statistically significant random sample of data. Your review experts also provide relevancy decisions for the same sample set.
  4. Cataphora assesses any differences between reviewers' decisions and the automated results.
  5. Cataphora makes adjustments to the system as necessary.
  6. Steps 3-5 are repeated until C-Relevance meets your accuracy goals.
  7. A final verification of the system is made prior to production.
  8. C-Relevance is run against the full target data set to produce the required automated review results.
